In August, the judge granted ABI’s request for summary judgment in part, ruling that ABI does not infringe the asserted claims of the ‘341 and ‘597 patents. However, he denied to rule on ABI’s non-infringement of the first claim of the ‘119 patent. The suit, in which ABI accuses Illumina, Solexa, and its former IP counsel of taking intellectual property from it, is scheduled to proceed to trial in early January.
